E-bike regulation update

The recent threat to ban e-bikes from trains and metros has once again highlighted the inadequacy of (non)existing vehicle classifications for e-bikes and inconsistencies with state e-bike usage regulations.  These are complex issues, with roll on implications not just for retail bikes, but also for the e-bike hire tourism market with a range of legislative updates required at both federal and state level. Both Bicycle NSW and WeRide (national bike advocacy group) have been working closely with state and federal politicians on the requirements for legislation.  

 

At the federal level, the local member for Mackellar, Sophie Scamps has proposed a legislative amendment to separately define power-assist and powerful e-bikes as vehicles. This would assist in classifying these e-bikes nationally and form the basis for state legislators to consistently set their road and/or path usage regulations for each of these categories.  This bill was seconded by Bradfield local MP Nicolette Boele after she discussed the issue with Bike North's Carolyn New who then connected her to WeRide contacts.  As a private members bill this may not get the necessary traction with the major parties, but regardless of the proposal outcome, it serves to continue to raise this issue at the federal level and put pressure on a satisfactory outcome at all government levels. 

 

We understand that at the last meeting of state ministers  (the Infrastructure and Transport Ministers Meeting), they resolved to set a standard approach across states and WeRide is working closely with them on those standards for their next meeting in November.  There are also reviews underway in the parliaments of Qld, Vic and NSW about e-bikes.  Bicycle NSW is also working with the NSW minister, which has helped establish this national approach.  We also understand that WeRide is meeting soon with ACCC and that minister Andrew Leigh, as the ACCC ensures that imported goods meet Australian laws.
